Terms of Service

Please read these terms carefully. By creating an account or using RentTrack PNG you agree to be bound by them. If you do not agree, please do not use the service.
1. Who we are
RentTrack PNG ("the Service", "the software") is produced and operated by JMK IT Solutions ("we", "us", "our"), a business operating in Papua New Guinea. You can contact us at contact@jmkits.net or via jmkits.net.
2. What the Service does
RentTrack PNG is a record-keeping and administration tool for residential and commercial rental properties. It allows landlords to record properties, units, tenants and leases; to generate and issue rent invoices and receipts; to track payments and arrears; and to communicate with tenants about those matters. Tenants may view their own records, submit evidence of payment, and raise disputes.
The Service records and assists with tenancy arrangements. It does not create, replace or alter the legal relationship between a landlord and a tenant, and it does not provide legal, financial, accounting or taxation advice.
3. Accounts
- You must provide accurate information when registering and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account.
- You must notify us promptly at contact@jmkits.net if you believe your account has been compromised.
- You must be legally capable of entering into a binding agreement to use the Service.
- Accounts are for the use of the registered person or business. Do not share login credentials.
4. Landlord responsibilities
If you use the Service as a landlord, you enter and control information about other people — your tenants. In relation to that information:
- You confirm you have a lawful basis to collect and hold it.
- You will use it only for the purpose of managing the tenancy.
- You are responsible for its accuracy, including rent amounts, due dates and payment records.
- You will comply with the laws of Papua New Guinea applicable to tenancies, record-keeping and the handling of personal information.
We act only as the provider of the software that stores and processes this information on your instruction. You remain responsible for the information you choose to record.
5. Subscriptions and payment
- The Service offers a free plan and paid plans. Plan features and limits are shown on the Subscription page and may change with reasonable notice.
- Prices are shown in Papua New Guinea Kina (PGK) and are payable in advance for each billing period.
- Paid plans purchased by card renew automatically at the end of each billing period until cancelled. You may cancel at any time; access continues until the end of the period already paid for.
- Payments by bank transfer are activated once we have verified your receipt.
- Card payments are processed by our payment provider. We do not receive or store your full card details.
- If a subscription is not renewed, your account moves to a grace period and then to the free plan. Units beyond the free plan's limit become read-only — your data is retained, but you will not be able to edit those records until you upgrade again.
- Except where required by law, fees already paid are non-refundable. If you believe you have been charged in error, contact us and we will investigate.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, or to harass, threaten or defraud any person.
- Record information about a person without a lawful basis for doing so.
- Attempt to access accounts, data or systems you are not authorised to access.
- Copy, modify, redistribute, resell, rent, or reverse-engineer any part of the Service.
- Interfere with the operation or security of the Service, or attempt to circumvent plan limits.
- Upload material that is malicious, or that infringes another person's rights.
7. Automated messages
The Service sends emails and notifications on your behalf, including rent invoices and payment receipts to tenants. By recording a tenant's email address you confirm you are entitled to contact them at it for tenancy purposes. We make reasonable efforts to deliver these messages but cannot guarantee delivery, as this depends on mail providers, spam filtering and network availability outside our control. You should not rely solely on an automated message as proof that notice has been given.
8. Your data and intellectual property
The records you enter remain yours. You grant us permission to store and process them only as needed to operate the Service for you, as described in our Privacy Policy.
The Service itself — including its software, source code, design, branding and documentation — is the intellectual property of JMK IT Solutions and is protected by copyright. Nothing in these terms transfers any ownership in the Service to you. You receive a limited, non-exclusive, non-transferable right to use it while your account is active and in good standing.
9. Availability
We aim to keep the Service available and accurate, but it is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free. We may suspend access temporarily for maintenance, upgrades, or to protect the security of the Service.
10. Limitation of liability
To the fullest extent permitted by law, JMK IT Solutions is not liable for indirect or consequential loss, loss of profit, loss of business, or loss arising from your reliance on figures, reports or messages generated by the Service. You should verify amounts before relying on them for legal, tax or accounting purposes.
Where liability cannot lawfully be excluded, our total liability in connection with the Service is limited to the amount you paid us for it in the twelve months before the claim arose.
Nothing in these terms excludes any right or remedy that cannot be excluded under the laws of Papua New Guinea.
11. Disputes between landlords and tenants
The dispute feature is a communication and record-keeping tool. We are not a party to, and take no role in deciding, any dispute between a landlord and a tenant. Such matters remain governed by your tenancy agreement and by Papua New Guinean law.
12. Suspension and termination
You may stop using the Service and request deletion of your account at any time by contacting us. We may suspend or terminate an account that breaches these terms, is used unlawfully, or where fees remain unpaid. Where practical we will give notice first. On termination you may request an export of your records before they are deleted, subject to any period we are required to retain them.
13. Changes to these terms
We may update these terms as the Service develops or as the law requires. The "last updated" date above will change, and material changes will be notified in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of Papua New Guinea, and the courts of Papua New Guinea have jurisdiction over any dispute arising from them.
